The agreement between you and MarksUp. Last updated 16 September 2026.
MarksUp is provided by an individual sole trader in the United Kingdom (“we”). Contact: privacy@marksup.uk.
By creating an account you accept these terms. If you do not accept them, do not create one.
You must be 18 or over and a teacher, tutor or someone otherwise responsible for assessing the work you upload. MarksUp is not for students to use on their own work.
If you are using it on work produced by students at a school, you are responsible for having your school’s agreement to do so. See the privacy page.
MarksUp reads an essay and returns a mark against an exam board’s assessment criteria, with annotated feedback. The judgement is made by a large language model.
It is a second opinion and nothing more. It will sometimes be wrong, and it will sometimes be wrong confidently. Every report can be overridden, and the mark you record is the one that counts.
You must read the marking before you act on it. Do not put a mark from MarksUp into a report, a predicted grade, a set of data for a school, or anything a student or parent will rely on, without having read the script and satisfied yourself the mark is right. It is a tool for a professional, not a replacement for professional judgement.
The assessment criteria used are our own paraphrase and interpretation of published mark schemes. MarksUp is not affiliated with, endorsed by, or approved by AQA, Edexcel, OCR, Eduqas, WJEC or Cambridge, and nothing here is an official mark.
Do not try to overload the service, get round its limits, or use it to run large volumes of work that is not real marking. There are caps, and hitting them deliberately is a reason for us to close an account.
Payment is handled by Stripe. If prices change we will give notice first; tickets you have already bought stay yours, and a monthly plan keeps the price it started on for as long as it runs without a break.
Unused tickets can be refunded within 14 days of purchase — email us. Tickets already spent on marking cannot, because the marking has been done and it cost us money to do it. A monthly plan can be cancelled at any time and is not refunded part-way through a month.
If something goes wrong at our end and you have paid for marking you did not get, tell us and we will put it right. Nothing here affects your statutory rights as a consumer.
You keep every right in the essays you upload and in the feedback produced from them. You give us permission to process that work only so far as is needed to mark it and show you the result — which includes sending it to the provider named on the privacy page.
We do not use your uploads to train anything, and we do not sell or share them.
The software, the design and the written interpretation of the assessment criteria remain ours.
MarksUp is early software run by one person. It may be unavailable, it may change, and features may be withdrawn. We try to keep it up and we back it up nightly, but it is not a system of record: export anything you need to keep. Marking is deleted after 30 days in any case.
Plain version: if MarksUp costs you money through our fault, what you can recover is limited to what you have paid us, and we are not liable for indirect losses.
In particular, we are not liable for the consequences of a mark being wrong. The service tells you plainly that it is a second opinion to be checked, and these terms require you to check it.
Nothing in these terms limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited in law.
You can stop using MarksUp whenever you like and ask us to delete your account. We can close an account that breaks these terms, and in that case we will refund any unused tickets unless the reason is something dishonest.
If these terms change in a way that matters, the date at the top changes and anyone with an account is told by email.
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction — which does not take away any right you have to bring a claim where you live.
